I have a solid track record of obtaining significant financial awards for staff members in appeals to Administrative Tribunals. Here are just a few examples:

G-5 staff member appealed decision rejecting her sexual harassment complaint; Tribunal found sexual harassment had been proven and investigation was seriously flawed; 25,000 EUR in moral damages and 7,000 EUR cost.

Delay in processing G-4 staff member’s application for disability pension was held to be in breach of principle of good faith.  Result:  20,000 EUR in moral damages; 7,000 EUR costs.

Represented Head of Human Resources Division in appeal of decision to terminate fixed-term appointment for alleged change in nature and functions of the post.  Result: Tribunal awarded 118,000 EUR for material and moral damages, and legal costs.

Represented G-5 staff member in appeal of non-extension decision. Result: Tribunal awarded 80,000 USD for material and moral damages. Follow-up claim on harassment is pending.

Represented G-5 staff member in appeal of decision to cut off benefits for loss of earning capacity at the age of retirement. Result: Tribunal decided that the payment of benefits shall continue beyond retirement age for as long as the disability continues and awarded 7,000 EUR for moral damages and 4,000 EUR for costs.

Represented Inspector General of the Global Fund in appeal for unlawful dismissal and defamation appeal. Result: Tribunal awarded material damages in the amount of 3 years and 4 months‘ salary; 150,000 CHF moral damages; 15,000 CHF costs; retraction of News Release from GF website.

Represented P-5 Systems Analyst against termination decision. Result: Tribunal awarded 7,5 months‘ salary; 60,000 USD material damages for lost opportunity for contract extension; 20,000 USD moral damages; costs of the internal appeal; 8,000 CHF costs.

Represented P-5 Chief of the Procurement Section in the Division of Administration in seeking enforcement of Judgment 3162. Result: Tribunal ordered payment of additional material damages of 86,481.35 euros plus interest; 7,500 euros costs.

Represented G-5 Senior Office Clerk against decision to deny full reimbursement of her swimming medical therapy and the decision to deny reinstatement of sick leave days taken for swimming therapy. Result: decisions set aside; reinstatement of sick leave; 414 euros material damages with interest at 5 per cent per annum; 2,000 euros costs.

Represented G-5 Senior Office Clerk against decision to deny reclassification of her post retroactively to 2003. Result: decisions set aside; job classification to be reviewed by an independent classifier based on the 2 December 2008 job description within 3 months; 15,000 euros moral damages; 4,000 euros costs.

Represented P-5 Regional Information Technology Officer holding a permanent appointment against decision of UNICEF not to reabsorb staff member at the end of the secondment. Result: Decision rescinded; 2,000 USD moral damages.

Represented P-5 Chief of the Procurement Section in the Division of Administration against termination decision. Result: decision set aside; 30,000 euros moral damages, material damages in the amount equivalent to 3 year’s salary, allowances and other benefits, and 10,000 euros costs.

Represented P-4 Human Resource Specialist against decision denying promotion. Result: decision set aside; 35,000 euros material damages, 15,000 euros moral damages, and 3,000 euros costs.

Represented G-4 Project Clerk against decision not to extend her contract after her sick leave replacement was appointed. Result: decision set aside; Tribunal awarded 2 years‘ salary and benefits plus interest; 15,000 euros moral damages, and 5,000 euros costs.

Represented G-5 Senior Printing Technician against decision not to extend contract until age of entitlement to a full pension under the Austrian Pension Insurance Scheme. Result: decision set aside; Tribunal awarded 1 year’s salary and benefits, 10,000 euros moral damages and 5,000 euros costs.

Represented D-2 Director of the Internal Oversight Group against reassignment (demotion) decision to a field post at the D-1 level. Result: decision set aside; material damages in the amount of difference between D-1 and D-2 for period of 3.5 years; 25,000 euros moral damages, and 5,000 euros costs.

Represented P-3 Inspector against decision to terminate probationary appointment. Result: decision set aside; 35,000 euros material damages, 15,000 euros moral damages, and 3,000 euros costs.

 Represented G-4 Personnel Clerk whose request for post reclassification was rejected. Result: decision set aside and remanded with instructions to carry out classification of post, 10,000 euros moral damages, and 3,000 euros legal costs; organization subsequently classified post at G-5 level and paid difference between G-4 and G-5 salary for 3 year period with interest.

Represented D-2 Managing Director against decision not to implement contract for Regional Director post in India. Result: decision set aside, 2 years‘ salary and benefits, 10,000 euros moral damages, and 5,000 euros legal costs.

Represented P-5 O&M Coordinator against decision to terminate probationary appointment. Result: decision set aside, salary and benefits for almost 2 years, 10,000 euros moral damages, and 5,000 euros costs.

 Represented P-3 Radionuclide Officer in claim of harassment and mobbing related to decision not to extend contract. Result: decision set aside, 35,000 euros moral damages, and 5,000 euros legal costs; in follow-up case involving non-extension of contract, Tribunal awarded 15,000 euros moral damages and 5,000 euros costs. Overall, staff member obtained 50,000 euros in moral damages alone for unlawful decisions and treatment by organization.

Represented Division Director against decision not to extend contract beyond retirement. Result: six months‘ salary plus 10,000 euros moral damages, and 5,000 euros legal costs.

 Represented P-3 staff member subject to 7 year service limit against decision not to offer new 7 year tour of service. Result: decision set aside, 2 years‘ salary and benefits, 10,000 euros moral damages, and 10,000 euros costs.
